Terms and Conditions
Sponsor and Exhibitor agree:

Space. The Sponsor hereby offers to make available to the Exhibitor a space that is, square (visible from three sides) and 256 sq. ft. for the purpose of presenting a Garden Display at Bangor’s Garden Show to be held in the Bangor Auditorium on Friday and Saturday, April 6 & 7 from 10am-6pm and on Sunday April 8, 2012 from 10am-4pm subject to the provisions outlined in this agreement. All space contracted for must be paid in full at the time application is approved.

- Spaces will be assigned by a random drawing
- The space may not be re- assigned or sub-let without the written permission of the Sponsor.
- Exhibitor will supply the Sponsor with a Certificate of Insurance, no later than March 15, 2012, evidencing General Liability and Property Damage coverage of no less than $1,000,000.00 each, per occurrence. The certificate will name the City of Bangor and Bangor Historic Track, Inc as Certificate Holders and Additional insured. Exhibitor must also show proof of Workers Compensation and Employers Liability coverage.
Exhibit Prizes. The Sponsor will retain the services of three (3) Judges (deemed by the Sponsor to be knowledgeable and competent) to judge the Exhibits based on the parameters outlined in number 3 (below). The decisions of the judges will be final. Prizes to be awarded will be; 1st place $5,000., 2nd place $2,500., 3rd place $1,500., Honorable Mention $750. All payments will be subject to the final and faithful completion of any and all obligations that the Exhibitor has assumed with the signing of this agreement.
Exhibit Design and Display Criteria. All Exhibitors must submit a floor plan, drawn to scale and a ‘Statement of Intent’ which briefly outlines their vision/plan/theme for their exhibit and the ‘key elements’ they will employ to accomplish their objective(s) no later than January 30,2012. Exhibitors are encouraged to follow accepted industry standards and to showcase the use of materials and plants that are readily accessible in our area. Exhibits will be judged on how well Exhibitors attain the goals as outlined in their Statement of Intent and the following design criteria:

- Use of Scale. Are the elements of the display in proportion to one another? Is the organization and comparative size of spaces within the display and the organization and comparative size of the elements as they relate to the total design pleasing to the eye?
- Appropriate use of color. Does the color scheme enhance the design? Is it appropriate for the stated intent/theme. Is it successfully used to carry out the principles of design in the display (as a focal point, to achieve balance, emphasis or sequence)
- Theme Development. Does the design adequately convey the stated intent/theme? What elements, in particular, contribute to the successful presentation of the exhibit’s intent/theme?
- Unity of Design. Does the exhibit achieve a harmonious combination of form, color and texture? Is there a unity of the exhibit parts? Is there a unity of exhibit interest (does the exhibit successfully incorporate a center of interest)?
- Elements of Design. How well does the exhibit incorporate all the basic elements of design (including Use of Repetition, Use of Variety, Use of Balance, Use of Emphasis and Use of Sequence)?
Move In and Move Out. Exhibitors may start loading into the Auditorium on Monday April 2 at Noon. The Sponsor will have a 5,000lb fork lift, with driver and small front end loader, with operator, available to assist with load in. The Auditorium will remain open until 2:00am on Tuesday April 3. Subsequently the Auditorium will be open on Tuesday the 3rd and Wednesday the 4th from 6:30am until 2:00am construction of displays. Judging will take place on Thursday April 5 from 8:00am- Noon. Exhibitors may start breaking down their display at the close of the Show, Sunday April 8, 4:00pm. Please note, fork lift and loader service will not be available until 8:00pm (earlier, if Vendor move-out permits), allowing time for Vendors to move out and booth decorations to be dismantled. All display elements must be out of the building by midnight, to allow for a changeover for another show. Please plan accordingly!
Signage. Brochures, business cards etc, not to exceed 8.5” x11” in size may be located within your display. No other signage will be allowed.
Labeling. Sponsor supplied, numbered tags will be available to aid in identifying individual plants. It will be the responsibility of the Exhibitor to place these tags and to supply a printed sheet to the public with a list of tag numbers and corresponding scientific and common names for the plants in their display.
Accessories. Exhibitors are encouraged to use discretion and restraint in selecting accessories to enhance their display. No artificial plants, flowers or foliage will be permitted .No cut trees or shrubbery will be permitted. All bedded plants must have their pots or root balls concealed.
Water Effects. In all cases where water effects are incorporated in a display it is the Exhibitors responsibility to ensure that proper planning and suitable materials are used to prevent leaking and contact with electrical appliances or outlets. If, in the discretion of the Sponsor, the water effect is deemed to be unsafe or that sufficient care was not taken to prevent leaking the exhibitor will be required to eliminate the feature from the display.
Non-Conforming Display. Sponsor reserves the right to disqualify any display which varies significantly from the submitted intent/theme.
Protection of Property. The Sponsor will make reasonable efforts to secure the property of Exhibitors and Displays. However the Sponsor will not be liable for the loss, theft, damage to any property, plants etc. that are part of a Display or used in the creation of the Display.
Bark Mulch. Sponsor will supply, at no charge up to 15.0 yards of bark mulch per display and will be responsible for the removal of the material after the Show.
Professional Performance and Communication. Exhibitor and Sponsor will endeavor to maintain the highest level of professionalism in their dealings with each other and the public. Both parties agree that a well run Show, that delivers a first class product to the public is in the best interest of all and shall be the goal that guides all interactions between the parties.
